Terms of Service

1. These terms, and the other three

By using postermu.com you agree to these terms. If you don't agree, please don't use it.

Three companion documents form part of this agreement and are worth reading in their own right: Non-commercial use & data sources (what you may do with a poster, and the licence terms of every API behind it), Privacy (what we store), and Refunds (what happens to your money). Where the non-commercial rules and these terms overlap, the non-commercial rules win — they're the ones you actively accepted.

3. Your account

• You must be at least 13 years old. If you're under the age of majority where you live, you need a parent or guardian's permission.
• Give accurate information and keep your email address current — it's how we reach you about purchases and security.
• Your account is yours. Don't share it, don't sell it, and don't use anyone else's.
• Sign-in is handled by Google Firebase, so the security of your Google or email account is part of the security of this one.
• Tell us promptly if you think someone else has access. You can revoke every existing session yourself from Account settings.

4. What you're allowed to do with PosterMu

While your account is in good standing we grant you a personal, non-exclusive, non-transferable, revocable licence to use PosterMu and to make posters with it, subject to these terms and to the non-commercial rules.

You may not resell, sublicense, rent out or white-label access to the service, scrape it, or use it to build a competing product.

5. Posters you make

The poster file you download is yours to keep, print and hang. What you may not do is sell it, or use it commercially, because the album art, key art, stills, lyrics, logos and statistics inside it belong to their rights holders and no plan you buy here licenses them.

That is the whole point of the non-commercial rule you accept before your first fetch, and it survives the end of this agreement. Full detail — including every provider's own terms — is at Non-commercial use & data sources.

6. Designs you submit

Read this section before you upload anything. If you submit a design to PosterMu, ownership of that design passes to us, and we can then do as we like with it — including changing it and selling from it — without owing you anything. That is the trade for hosting it, rendering it, reviewing it, promoting it and putting it in front of every customer on the site. If you aren't comfortable with it, don't submit the design — nothing else on PosterMu requires you to.

• You assign it to us. When you submit a design you assign to PosterMu, worldwide and for the full term of the rights including all renewals and extensions, all copyright and other intellectual property in that design — the file you upload, its layers, layout and artwork, and the previews and renders made from it. The assignment takes effect the moment you submit, and you agree to sign anything reasonably needed to confirm or record it.
• If an assignment can't take effect where you live — some countries limit the assignment of future or unregistered rights — you instead grant us an exclusive, perpetual, irrevocable, worldwide, royalty-free licence, sublicensable and transferable, to do everything the assignment would have allowed. So far as the law permits you waive your moral rights in the design; where they can't be waived you agree not to assert them against us or against anyone we license.
• What that lets us do: anything an owner can. Store, render, modify, adapt, edit, recolour, combine with other work, rename, promote, publish, distribute, license, sublicense, sell and commercially exploit the design and anything made from it — on this site, in any other product or medium, and in any that doesn't exist yet. We can do that in whole or in part, keep it or retire it, and transfer it with the business. None of it needs your consent, your credit or a payment to you.
• What you can still do. We licence the design back to you — free, non-exclusive, for as long as you want it — so you can keep your own copy, keep using it, show it in your portfolio as your work, and make posters with it under the same non-commercial rules as everyone else. What you can't do is licence it to someone else, or stop us using it.
• Credit is our practice, not a promise. A listing goes live under your username and normally stays that way, and we've no reason to strip a creator's name off their work — but as owner we aren't contractually bound to keep it there.
• Your source file isn't handed out today. There is no route on this site that gives anyone the PSD you uploaded; it's used to render posters and previews. That describes how the service works now, not a permanent restriction on what an owner may do with a file it owns.
• You promise it's yours to give — that you made it, that you hold every right you're assigning, that nobody else has a claim over it (an employer, a client, a co-author), and that it doesn't infringe anyone's copyright, trademark or other rights.
• Designs are reviewed before going live, and we may decline, unpublish or remove one at any time — including on a rights holder's complaint. You can unpublish your own listing whenever you like; that takes it out of the gallery, but it doesn't undo the assignment.
• There's no payment for uploads. Submitting is voluntary and unpaid, and the assignment above is part of what you get the service for. If we ever introduce a creator payout it will come with its own terms.

7. Things you must not do

• Break the law, or use PosterMu to infringe someone else's rights.
• Upload malware, or anything obscene, hateful, harassing or sexualising minors.
• Attack or overload the service — scraping, brute force, denial of service, or automated bulk requests outside what the site's own interface does.
• Try to get around paywalls, usage limits, watermarks or access controls, or help anyone else do so.
• Reverse engineer the service except where the law expressly permits it.
• Misuse other people's API keys, or use ours in ways the provider forbids.
• Impersonate anyone, or misrepresent your connection to a person or organisation.

8. Paying

• Prices are shown on the pricing page, in the currency stated there, and exclude any taxes that may apply where you live.
• Payment is processed by Stripe. Your card details go to them, never to us.
• What's on sale is poster credits: one credit produces one poster download, and credits don't expire while your account is open.
• If you hold a subscription from when plans were sold, its monthly allowance resets each calendar month and doesn't roll over, and it renews automatically until cancelled. Cancel any time from Account → Billing; access continues to the end of the period you've paid for.
• We may change prices, and will give notice before a renewal at a new price. Refunds are covered by the refund policy.

9. The service will change, and sometimes break

PosterMu is actively developed and depends on third-party APIs we don't control. Designs, features and media types may be added, changed or withdrawn — sometimes because a provider changed or withdrew theirs.

We don't promise any particular uptime. We may take the site down for maintenance, and we'll try to make that brief. If we discontinue the service entirely, we'll give reasonable notice and a fair way to deal with unused paid access.

10. Suspension and termination

You can stop at any time: stop buying credits, cancel any subscription you still hold, or delete your account outright from Account settings.

We may suspend or close an account that breaks these terms, uses the service unlawfully, charges back a legitimate payment, or puts the service or other users at risk. Where it's reasonable to do so we'll warn you first and give you a chance to put it right.

If we close your account for a serious breach, unused credits and remaining subscription time are forfeited. If we close it for any other reason, or discontinue the service, we'll refund unused paid access on a fair basis. Sections 5, 6, 11, 12, 13 and 14 survive the end of this agreement.

11. No warranties

PosterMu is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties — merchantability, fitness for a particular purpose, non-infringement.

In particular we don't warrant that the service will be uninterrupted or error-free, that a poster will be free of defects or suitable for any particular print process, or that data fetched from a third-party API will be accurate, complete or current. Check a proof before you spend money printing anything.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, or the cost of printing — including where a poster was printed using inaccurate data from a third-party source.

Our total liability arising out of or relating to the service, in any 12-month period, is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $50.

Nothing in these terms limits liability that cannot be limited by law — including fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or your rights as a consumer under the law where you live.

13. Indemnity

If someone brings a claim against us because of how you used PosterMu — a design you published, content you uploaded, a commercial use of a poster, or a breach of these terms — you agree to cover the reasonable costs and damages that result. We'll tell you promptly about any such claim and won't settle it without talking to you.

14. Governing law

These terms are governed by the laws of Alberta, Canada, and the courts there have jurisdiction.

If you're a consumer somewhere else, this doesn't take away the protection of the mandatory consumer laws of your own country, or your right to bring a claim there.

15. Changes to these terms

We may update these terms. If a change is material we'll give notice on the site before it takes effect, and the version date below will change. Continuing to use PosterMu after that means you accept the new version. If you don't, stop using the service and — if you've paid for access you no longer want under the new terms — contact us.

16. Odds and ends

• If a court finds part of these terms unenforceable, the rest still applies.
• Not enforcing something once doesn't waive our right to enforce it later.
• You may not transfer your rights under these terms; we may transfer ours if the service is sold or reorganised, without reducing your rights.
• These terms and the three documents named in section 1 are the whole agreement between us about the service.
